
Pharmacy Lien Withdrawn Before Trial Following Strategic Defense

Argus West’s SPEAR Program successfully secured a $0 payment on a $2,928.49 pharmacy lien after preparing a thorough defense package.
Despite an Order requiring the submission of PTCS, the pharmacy lien claimant failed to file the necessary documentation despite repeated requests. As the trial approached, the WCAB Judge issued a strong recommendation, advising the lien claimant that failure to provide the required PTCS could result in being liable for fees and costs. The Judge further suggested that the lien claimant withdraw their lien to avoid further financial consequences.
Faced with the looming risk of sanctions and mounting pressure, the pharmacy lien claimant withdrew the lien prior to Trial. The Trial was continued, with an additional issue of sanctions to be heard, as the defendant may file a Petition for Costs in light of the lien claimant’s repeated delays.
