
Fraudulent Claim Uncovered: Surveillance and SIU Investigation Lead to Criminal Charges

A client of Argus West received a tip from their insured regarding a fraudulent claim. The claimant was working for a construction company and filed a workers’ compensation claim, alleging injuries to his shoulder, back, and internal organs from lifting rocks. He was placed on temporary disability, later transitioning to partial permanent disability. However, suspicions arose that the claimant was working while receiving benefits.
Sub rosa was requested and quickly obtained by the Argus West surveillance team. The claimant was observed purchasing stucco materials and performing physical labor, including applying stucco to a building, using a ladder, and carrying heavy construction materials at a private residence. These activities directly contradicted his claims of being unable to work due to his injuries.
Surveillance footage revealed the claimant working for hours at a time, which contradicted his testimony to multiple medical examiners. SIU submitted a detailed referral package to the Department of Insurance, leading to the claimant being charged with two counts of insurance fraud and two counts of perjury by the Santa Barbara District Attorney’s Office.
The case was a success due to the careful surveillance and SIU investigation that exposed the claimant’s fraudulent activities. By holding the claimant accountable, the investigation ensured the integrity of the workers' compensation system, preventing abuse of benefits meant for legitimate claimants.
